Nghiên cứu này được thực hiện tại huyện Thanh Oai, thành phố Hà Nội để đánh giá thực trạng, xác định những hạn chế nhằm đưa ra các giải pháp tăng cường công tác đăng ký thế chấp quyền sử dụng đất và tài sản trên đất. Trong giai đoạn 2011 – 2015, có 5.589 hồ sơ đăng ký thế chấp và 3.067 hồ sơ xoá đăng ký thế chấp được thực hiện tại chi nhánh Văn phòng Đăng ký đất đai huyện Thanh Oai. Số lượng đăng ký tăng lên trong những năm gần đây, điều đó cho thấy vốn đóng một vai trò quan trọng trong sự phát triển kinh tế của huyện. Nhìn chung, người dân đánh giá cao về trình tự, thủ tục đăng ký thế chấp quyền sử dụng đất, tài sản trên đất. Để khắc phục những tồn tại, vướng mắc khi đăng ký thế chấp quyền sử dụng đất, tài sản trên đất tại huyện Thanh Oai, cần thực hiện các giải pháp sau: đẩy nhanh việc cấp giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất; hoàn thiện hồ sơ địa chính, cập nhật những thay đổi về sử dụng đất; tăng cường ứng dụng công nghệ thông tin trong quản lý đất đai nói chung và đăng ký thế chấp quyền sử dụng đất nói riêng; hoàn thiện cơ chế vay vốn; thiết lập cơ chế trao đổi thông tin giữa các cơ quan liên quan đến việc đăng ký thế chấp quyền sử dụng đất, tài sản trên đất; tăng cường đội ngũ cán bộ giải quyết các thủ tục về đất đai.

Current status of registration of mortgaging of land use rights, assets attached to land in Thanh Oai district, Ha Noi city

SUMMARY
This study was conducted in Thanh Oai district, Ha Noi city to assess the current status, identify the obstacles that serve as the basis for proposing solutions to strengthen the registration of mortgage of land use rights and assets attached to land. In the period of 2011 – 2015, the land registration office branch of Thanh Oai district completed 5.589 files of mortgage registration and 3.067 files of mortgage registration removal. The number of registrations have increased in the recent years; that has shown that capital plays an important role in the economic development of the district. In general, people have highly appreciated about the order and procedures of registration of mortgage of land use rights and assets attached to land in the land registration office branch of Thanh Oai district. In order to overcome shortcomings and obstacles in registration of mortgage of land use rights and assets attached to land in Thanh Oai district, the following measures should be proposed: speeding up the issuance of certificate of land use, house and other assets attached to land ownership; completing the cadastral records, updating the changes in land use; enhancing the application of information technology in land management in general and registration of mortgage of land use rights in particular; finishing the mechanism of borrowing capital; establishing the mechanism for the exchange of information between agencies that involves in the registration of mortgage of land use rights, assets attached to land; increasing the staff to solve land administrative procedures.
